Force majeure
Posted August 29th, 2007 by DCT
The Pactix force-majeure language sets out simple, generic criteria for being excused from performance by a force-majeure event. It also includes an optional “laundry list” clause that can be plugged in if desired.
Some points to note
- Some contract negotiators balk at allowing personnel-related matters (labor unrest, strikes, etc.) to constitute a force-majeure event.
- "Acts of God" might be too vague for some people's taste.
